Terms and Conditions

Retainers, Deposits, Payments & Taxes

1. The date of the event is considered “booked” upon receipt of a non-refundable booking fee equaling 50% of the total value of the cake(s), delivery charges, and equipment deposit.

2. The final payment for custom cake orders is due 3 days prior to cake collection, or 3 weeks prior to orders that are to be delivered to the venue.

3. If the Client fails to make payments, Inspired Cakes by Amy will cease work, the order will be canceled and no refund will be given.

4. The payment and receipt of a deposit signify that the client understands and agrees to all terms and conditions as outlined in this document.

Liability

1. Inspired Cakes – by Amy is not responsible for bodily injury, property, or consequential damage, which may result from services.

2. Inspired Cakes – by Amy is not responsible for any damage to the cake or shortage of cake caused by anyone not employed by Inspired Cakes – by Amy

3. Inspired Cakes – by Amy will not deliver a cake if payments have not been paid in full.

Fulfillment of Contract

1. Inspired Cakes – by Amy is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay in supplies, disputes or strikes, or any other circumstance beyond  Inspired Cakes – by Amy’s control.

2. If Inspired Cakes - by Amy has completed the cake but it can’t be delivered due to uncontrollable circumstances, the Client will be refunded 50% of the total cost.

3. If the Client picks up the cake, Inspired Cakes - by Amy no longer assumes any responsibility for damage caused to it.

Postponement/Cancellation

1. The Client must notify if there is a change in the date of the event or complete cancellation.

2. If the postponement occurs before 30 days of the event, no penalty fee will be charged.

3. If the postponement occurs after 30 days prior to the event, the Client will be charged a 20% fee. There is no guarantee that another date will be available.

4. If a cancellation occurs 30 days prior to the date of the event, all money will be refunded minus the retainer fee.

5. If a cancellation occurs after 30 days prior to the event, 80% will be refunded less the non-refundable retainer fee.

Changes to Order

1. Any changes must be submitted 21 days in advance, and may not be possible.

2. There will be no changes allowed 14 days prior to the event.

Design of the Cake

1. Inspired Cakes – by Amy will follow the Client’s requests closely to create the cake desired. 

2. Inspired Cakes – by Amy cannot duplicate an exact copy of another cake artist’s work but can use images of other cakes as reference.

Serving Amount & Sizes

1. The average serving size is 1-inch wide x 2-inches long x 4 inches high.

2. Inspired Cakes – by Amy cannot guarantee an exact serving amount for sculpted cakes.

3. Serving size estimations are not guaranteed to be exact.

4. Inspired Cakes – by Amy is not responsible for a shortage of cake if the pieces are cut too large.

Allergy & Dietary Warnings

1. Inspired Cakes – by Amy’s baked goods contain gluten and may contain traces of nuts and other allergens including Natural dyes, artificial dyes, artificial flavorings, sugar, artificial sweeteners, artificial color, and other allergens not listed.

2. The Client is responsible for pointing out to guests potential allergy hazards

Ornaments & Special Equipment

1. A $100 deposit is required for all rental equipment.

2. The equipment must be returned within 24 hours of the event.

3. The returned equipment is evaluated and a refund of the deposit is based on the condition of the items.

4. All personally supplied items must be submitted to Inspired Cakes by Amy at least 14 days prior to the event

Delivery and Set-Up/Cake collection

1. Delivery is subject to availability as well as distance restrictions and will be charged in addition to the cake(s)/order.

2. Inspired Cakes – by Amy is not responsible for tardiness if the venue is changed within 48 hours of the event.

3. The Client may pick up the cake. The Client assumes liability once it passes into the Client’s possession.

4. Weekend collection times are between 9.00 am and 9.30 am only.

5. The Client MUST arrive on time to collect the cake. A late fee applies to orders collected after the agreed-upon time at a rate of $20 per 30 minutes. There are no guarantees that someone will be available at a time after the one agreed upon to collect the cake.

6. The Client is responsible for providing a suitable environment for the cake (away from heaters, vibrations, people, suitable surface, suitable outdoor setting).

Photographs

1. Inspired Cakes – by Amy reserves the right to use all photographs of the cake for advertising purposes.

2. Inspired Cakes – by Amy must be mentioned ( @inspiredcakesbyamy ) and tagged in social media posts where images of the cake have been published. A link to www.inspiredcakesbyamy.com must be displayed clearly along with images that have been published to a website, magazine, or other.
